Terms & Conditions

Functional Medicine CE — Effective Date: June 30, 2026

These Terms & Conditions (“Terms”) govern your access to and use of the website, online courses, digital products, and related services (the “Services”) offered by Functional Medicine CE (“FXMed,” “we,” “us,” or “our”). By creating an account, purchasing a course or pass, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

Our Services are intended for licensed and practicing healthcare professionals and individuals pursuing continuing education in functional medicine. You must be at least 18 years old to create an account and make purchases.

2. Account Registration

  • You must provide accurate, current information when creating an account, including your profession and state of practice.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You agree to notify us promptly of any unauthorized use of your account.

3. Digital Products and Course Access

  • Courses, certificates, podcasts, and other materials are delivered electronically and may include video, audio, written content, quizzes, and downloadable resources.
  • Access to purchased digital products is granted for personal, non-commercial educational use only. You may not share, resell, copy, distribute, or publicly post course content or login credentials.
  • Continuing education credit, where offered, is awarded according to the requirements of the applicable accrediting body and may require completion of quizzes or evaluations. FXMed does not guarantee that a specific licensing board will accept credit earned through our Services; it is your responsibility to confirm acceptance with your licensing or certifying body.
  • We reserve the right to update, modify, or discontinue specific course content, while making reasonable efforts to provide comparable replacement content or access where a course is discontinued after purchase.

4. Pricing, Payment, and Automatic Renewal

4.1 Pricing

All prices are listed in U.S. dollars and are subject to change. Price changes will not affect orders already completed.

4.2 Annual Pass and Subscription Products

  • Certain products, including an annual pass, are sold on a recurring, automatically renewing basis. By purchasing an annual pass, you authorize FXMed (or our payment processor) to automatically charge your payment method on file for each renewal term at the then-current price, unless you cancel before the renewal date.
  • Renewal terms are equal in length to your original subscription period (e.g., a one-year pass renews annually) unless otherwise stated at the time of purchase.
  • We will provide notice of an upcoming renewal charge by email in advance of the charge where required by law or as a courtesy, using the email address on your account.
  • You may cancel automatic renewal at any time before the renewal date through your account settings or by emailing hello@functionalmedicinece.com. Canceling stops future renewal charges but does not entitle you to a refund of the current billing period unless required by law or otherwise stated below.
  • If a renewal payment fails, we may suspend access to subscription-based content until payment is successfully processed or the subscription is canceled.

4.3 Refunds

Because digital products are accessible immediately upon purchase, all sales are final except: (a) where required by applicable law, (b) where a course or product is materially defective or inaccessible due to our error, or (c) as otherwise expressly stated in a specific product’s listing at the time of purchase. Refund requests should be directed to hello@functionalmedicinece.com and will be evaluated on a case-by-case basis.

5. Intellectual Property

All course content, materials, branding, audio, video, and other content provided through the Services are the property of FXMed or its licensors and are protected by copyright and other intellectual property laws. Except for the limited license to access purchased content for personal educational use, no rights are granted to you.

6. Acceptable Use

  • You agree not to share your account access with others, attempt to circumvent access controls, scrape or copy course content, or use the Services for any unlawful purpose.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

7. Disclaimers

The Services are provided for educational purposes only and do not constitute medical advice, diagnosis, or treatment. Course content reflects the views of individual instructors and is not a substitute for independent professional judgment. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FXMED AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO FXMED IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold FXMed harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.

10. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms. You may close your account at any time by contacting us; closing your account does not entitle you to a refund for unused portions of a subscription except as described in Section 4.3.

11. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated effective date and, where appropriate, communicated by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
